There are some states where CPS has even more power and less oversight. They even have the power to “convict” a person of abuse without due process. I have twin boys who are very active, but also have some medical issues. We got a knock on the door from CPS when they were about 5 years old because of some bruising. The son in question had some speaking issues and was only mimicking (repeating back what was said). When the person who noticed the bruising asked about abuse my son mimicked everything they said. They used this as validation to enter my home. Even when I explained the bruising, and even provided hard evidence of the cause of the bruising (he had fallen on some wooden blocks while playing) CPS was adamant that I was abusing him. Even the state trooper with them has a hard time swallowing that assessment. They essentially verbally abused my wife in an attempt to get her to tell them I abused my children. When they started accusing her of complicity and threatening her with jail time if she didn’t tell them what they wanted to hear I told them to leave. Their response was “we will leave when we want to.” The trooper stepped in at that point and informed the CPS worker that they had to leave or I would be allowed to defend my home and family from them (the trooper had heard enough of their crap and was siding with my family). They left and we didn’t hear a thing from them for about a month. Then I received notice (as did my dad, for some stupid reason) that we were being put on a list of child abusers. No court. No jury. No formal notifications. Just a letter in the mail that could have easily been mistaken as junk mail. We of course fought it, as this list was required to be checked by all employers in the state (both my dad and I worked with/at the schools) and any employer that worked with children weren’t allowed to hire us. It took 2 years of fighting it in the courts (mostly because CPS kept changing lawyers, motioning to change judges, motioning to change venue to make it harder for me to appear and easier for their new lawyer, etc.). After 2 years though even the courts has had enough and ordered them to remove my dad’s and my name from the list. They removed my dad’s name, but changed my status to “suspected child abuser.” It took another year of their crap to finally get my name fully removed. Fortunately I was working for a company that understood the situation and allowed me to be continually employed so we didn’t lose our home or income.
