The problem I would see with this in theory is that if the officer can discern what is going on, then the officer himself is likely committing a felony voyeurism offense- thus lending the entrapment defense due to the supreme courts outrageous conduct doctrine with respect to sting operations generally. Public bathrooms are also a misnomer in the law- while they are public places, there is also the reasonable expectation of privacy from public view ordinarily speaking, thus lending questions in so far as Lawrence et al. v. Texas. This is because if the officer is conducting a sting operation, then the officer consents to the conduct. Lawrence made clear that the government cannot regulate consensual conduct between adults occurring in a location where there is a reasonable expectation of privacy, thus there must be a third distinct element of reasonable public view for there to be a crime. It cannot be a crime where someone looks over a partition, etc. because of the fact that a reasonable person doesn't expect another to engage in that sort of conduct contributing to an offense, thus the looking over a partition or similar conduct negates the mens rhea element, noting that mens rhea applies distinctly to each element of an offense, and not just to overall conduct. It would also double to mention that in theory that the government offering an attractive decoy to a homosexual male would be impermissible under certain circumstances, as such might be an impermissible invitation to commit an offense where there would not be a predisposition, given the body shaming culture of the gay community at large.
